WELL/BEINGS FARM DAY 2025
Event Terms and Conditions, Liability Waiver, and Photo Release

Event Location: 129 Spring Valley Road, Ridgefield, Connecticut

Date: September 13, 2025 (Rain Date: September 14, 2025)

1. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

In consideration for being permitted to participate in an event hosted by WELL/BEINGS (the “Organizer”) at the property located at 129 Spring Valley Road, Ridgefield, Connecticut, which is owned by Batavia Farm LLC (the “Property Owner”), on September 13, 2025, the undersigned hereby acknowledges, understands, and agrees that:

  • Participation in activities involving animals and outdoor environments inherently involves risks including, but not limited to, physical injury, illness (including zoonotic diseases), allergic reactions, property damage, or death. These risks may result from the actions, inactions, or negligence of participants, volunteers, animals, third parties, and/or the Organizer.

  • I, on behalf of myself, my minor child(ren), and our respective personal representatives, assigns, heirs, and next of kin, voluntarily assume all risks associated with this event, whether known or unknown, and accept full responsibility for any injury, damage, or loss which may result from such participation.

  • I hereby RELEASE, WAIVE, INDEMNIFY, AND HOLD HARMLESS WELL/BEINGS and the Property Owner, along their respective officers, directors, members, employees, agents, volunteers, representatives, successors, assigns, sponsors, property owners, affiliates, and any other associated parties (collectively, the “Released Parties”) from any and all claims, demands, actions, or causes of action, including those arising from negligence or the acts or omissions of the Released Parties.

2. MINOR PARTICIPATION

  • By my donation for any of the event’s ticketing options, I certify that I am the parent or legal guardian of the minor named below, and I have the legal authority to execute this waiver and release on their behalf.

  • I acknowledge that I am responsible for supervising my child(ren) at all times during the event.

  • I voluntarily allow my child(ren) to participate in the event and associated activities, including direct contact with animals, and agree to be bound by the terms of this agreement on their behalf.

3. ANIMAL HANDLING ACKNOWLEDGMENT

  • I acknowledge that animal behavior is inherently unpredictable and may result in injury.

  • I agree to follow all safety instructions provided by staff, signage, and/or volunteers. Failure to comply with any and all safety instructions or directions provided by staff and/or volunteers may result in removal from the premises.

4. MEDICAL TREATMENT AUTHORIZATION

  • I understand that medical emergencies may occur and that the Organizer or Property Owner may not have immediate access to emergency medical services or trained personnel.

  • In the event of a medical emergency involving myself or my child(ren), I authorize the Organizer to secure necessary emergency medical treatment and transportation as deemed appropriate. I agree to be fully responsible for all costs associated with such treatment.

5. PHOTO, VIDEO, AND MEDIA RELEASE

  • I grant the Organizer and its representatives the right and permission to record, photograph, film, or otherwise capture my likeness, image, testimonial, and/or sound recording and/or the likeness, image, testimonial, and/or sound recording of my child(ren) in all forms and media (collectively, the “Information”) during the event. I release the Organizer from any and all liability for its use of the Information and waive all claims and causes of action against the Organizer arising from the use of the Information.

  • I also grant a gratis, perpetual, worldwide, irrevocable license to the Organizer to use the Information in any manner of media to promote its work,  including but not limited to promotional materials, educational content, fundraising, public relations, and social media, and I understand that the Information may be edited or combined with other images, sound, text, or information. I disclaim all rights to all values and benefits the Organizer may gain through the use of the Information.

  • I understand and agree that any such media shall be the sole and exclusive property of the Organizer and may be used without further consent or notice.

6. RAIN DATE AND NON-REFUNDABLE DONATION ACKNOWLEDGMENT

  • The Organizer reserves the right to postpone the event scheduled for September 13, 2025, to the designated rain date of September 14, 2025, in the event of inclement weather or other circumstances beyond the Organizer’s control. By registering for or otherwise contributing to the event, the undersigned acknowledges and agrees that any donation made in connection with the event shall be deemed a 100% charitable contribution to WELL/BEINGS. Should the event be rescheduled to the rain date, and the undersigned is unable or unwilling to attend on such alternate date, the undersigned expressly agrees that no refund, credit, or compensation of any kind shall be due or payable, and the aforementioned contribution shall remain non-refundable in all respects.

7. GENERAL TERMS

  • I certify that I am physically and mentally capable of participating in the event and that I am not aware of any condition or limitation that would make participation unsafe.

  • This agreement shall be governed by the laws of the State of New York. Any disputes arising under this agreement shall be resolved in a court of competent jurisdiction located in New York.

  • If any provision of this agreement is held to be invalid or unenforceable, the remainder shall continue in full force and effect.

  • Through my donation for any of the ticketing options for the event, I acknowledge that I have read this entire agreement, I understand its contents, and sign it voluntarily and of my own free will.
